These documents govern your use of the Pair mobile application (the “App”, “we”, “us”, “our”). By creating an account or using the App, you agree to both the Terms of Service and the Privacy Policy below. If you do not agree, do not use the App. The App is operated privately; all enquiries go through the contact email below.
Terms of Service
1. Eligibility
You must be at least 18 years old (or the age of legal majority in your jurisdiction, whichever is greater) to use the App. By using the App you represent and warrant that you meet this requirement. The App is intended for private use between two consenting adults who have chosen to pair with each other.
2. The service
Pair lets two paired users exchange photos, videos, voice notes, text, moods, and reactions, surfaced on a home-screen widget. Content is short-lived and is designed to be removed automatically (see the Privacy Policy). The App is a personal, non-commercial communication tool.
3. Your account and security
- You are responsible for maintaining the confidentiality of your device and account, and for all activity that occurs under your account.
- Authentication is by phone number via a one-time code. You are responsible for keeping access to your phone number secure.
- You must notify us promptly of any unauthorized use.
4. Your content and conduct
- You own the content you create. You are solely responsible for it.
- You grant us a limited, non-exclusive licence to process, transmit, and temporarily store your content only as needed to operate the App (e.g. to relay an encrypted file to your partner).
- You agree not to use the App to create, send, store, or share content that is unlawful, abusive, harassing, defamatory, infringing, sexually exploitative of minors, or that violates anyone’s rights or any law. You are solely liable for content you transmit.
- We do not pre-screen content and are not responsible for content exchanged between users. Because most content is end-to-end encrypted, we cannot see, moderate, or recover it.
5. Encryption & content loss — assumption of risk
- Photos, videos, voice notes, and text messages are end-to-end encrypted on your device. We cannot read them and cannot recover them if lost.
- Content is designed to auto-delete after a short period and after delivery. We are not responsible for content that expires, fails to deliver, or is lost for any reason (including device loss, reinstall, key loss, network failure, or service interruption). Keep your own copies if you need them.
- Moods and reactions are not end-to-end encrypted.
- No method of transmission or storage is 100% secure. While we use reasonable measures, we do not warrant that the service is immune to interception, breach, or unauthorized access, and you use it at your own risk.
6. Service availability
The App is provided on an “AS IS” and “AS AVAILABLE” basis. We may modify, suspend, limit, or discontinue the App (or any feature) at any time, with or without notice, without liability to you. We do not guarantee uninterrupted, timely, secure, or error-free operation, or that messages will be delivered.
7. Third-party services
The App relies on third parties including Google Firebase (authentication, push notifications, crash reporting) and Supabase (encrypted relay and storage). Your use is also subject to their terms and policies. We are not responsible for the acts, omissions, availability, or data practices of these third parties.
8. Disclaimer of warranties
To the maximum extent permitted by applicable law, the App is provided without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty regarding security, availability, accuracy, or reliability.
9. Limitation of liability
To the maximum extent permitted by applicable law:
- We shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, content, profits, goodwill, or relationships, arising out of or relating to your use of (or inability to use) the App.
- Our total aggregate liability for any claim relating to the App shall not exceed the greater of (a) the amount you paid us for the App in the 12 months before the claim, or (b) USD $0 (the App is free).
- Some jurisdictions (including the EU/EEA and UK) do not allow certain limitations; in those cases the above applies only to the extent permitted, and nothing here limits liability that cannot lawfully be limited (e.g. for death, personal injury caused by negligence, fraud, or statutory data-protection rights).
10. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your content, your use of the App, or your breach of these Terms or any law or third-party right, to the extent permitted by applicable law.
11. Termination
We may suspend or terminate your access at any time for any reason, including violation of these Terms. You may stop using the App and delete your account at any time (see “Your rights” in the Privacy Policy). Sections that by their nature should survive termination (e.g. disclaimers, limitation of liability, indemnification) survive.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date. Continued use after changes constitutes acceptance.
13. Governing law & disputes
These Terms are governed by applicable law. Nothing in these Terms removes any mandatory rights you have as a consumer under the laws of your country of residence, and where such laws apply, you may bring proceedings there. Privacy Policy
We care about your privacy and collect the minimum needed to run the App. This policy explains what we collect, why, how long we keep it, and your rights.
1. Who is responsible
The App (“Pair”) is the data controller for the personal data described here. You can reach us at hello.pairapp@gmail.com for any privacy request or question.
2. What we collect
- Phone number — to authenticate you via a one-time code (through Firebase).
- An account identifier and a device identifier — to operate your account and to limit abuse (e.g. rate-limiting login attempts).
- A push-notification token — to alert you when your partner sends something.
- Your content — photos, videos, voice notes, and text you choose to send. These are end-to-end encrypted on your device before transmission.
- Moods and reactions — these are not end-to-end encrypted (they are sent as small signals so they can appear instantly).
- Pairing & profile details — your pairing relationship, an optional display name/nickname, time-zone offset, streak count, and any countdown you set.
- Encryption public key — stored so your partner’s app can encrypt to you.
- Limited session/diagnostic data — sign-in events (device type, app version, time) and, via Firebase Crashlytics, crash and diagnostic reports to help us fix problems.
We do not collect your contacts, location, or browsing history, and we do not use advertising trackers.
3. How we use it
- To authenticate you and operate pairing and messaging.
- To deliver notifications and content to your partner.
- To prevent abuse and secure the service.
- To diagnose crashes and improve reliability.
We rely on your consent and on the performance of our service to you as the legal bases for processing (GDPR Art. 6(1)(a) and (b)).
4. Encryption
Photos, videos, voice notes, and text are encrypted on your device using end-to-end encryption (X25519 key exchange + AES-256-GCM). We cannot read or recover them. Moods and reactions are transmitted without end-to-end encryption. No system is perfectly secure; we cannot guarantee absolute security.
5. How long we keep it
- Encrypted content blobs are deleted from our servers immediately after delivery.
- Local copies on your and your partner’s devices are designed to auto-delete after about 3 days unless explicitly saved.
- Limited metadata (e.g. timestamps, content type, delivery status, your public key, pairing records) is retained while your account/pairing is active.
- You can delete your data at any time (see “Your rights”).
6. Who we share it with
We do not sell, rent, or trade your personal data. We use these processors to run the App:
- Google Firebase (authentication, push notifications, crash reporting) — see Google’s Privacy Policy.
- Supabase (encrypted content relay, database, storage) — see Supabase’s Privacy Policy.
We may disclose data if required by law or to protect rights, safety, or the integrity of the service.
7. Where your data is processed
Our infrastructure (Supabase) is currently hosted in the United States, and Firebase is operated by Google. If you are in the EU/EEA or UK, your data may be transferred to and processed in the United States, which may have different data-protection laws. Where required, such transfers rely on appropriate safeguards (e.g. Standard Contractual Clauses) offered by these providers.
8. Your rights
Depending on your location (including under GDPR for EU/EEA/UK users), you may have the right to:
- Access the personal data we hold about you;
- Correct inaccurate data;
- Delete your data (“right to be forgotten”);
- Restrict or object to certain processing;
- Data portability;
- Withdraw consent at any time;
- Lodge a complaint with your local data-protection authority.
To exercise any of these, email hello.pairapp@gmail.com. To delete your account and associated data, unpair in the App and/or contact us; we will action verified requests within the period required by law.
9. Children
The App is not intended for anyone under 18. We do not knowingly collect data from minors. If you believe a minor has used the App, contact us and we will delete the data.
10. Security
We use reasonable technical measures, including end-to-end encryption for content and encrypted storage. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You use the App at your own risk.
11. Changes to this policy
We may update this policy; the “Last updated” date will change accordingly. Material changes will be communicated in the App or by updating this page.
